Warranty Terms and Conditions

Conditions for Warranty Coverage

  • The product must be returned to OBR/Red Rhino for inspection, freight prepaid by the dealer/purchaser or their customer, within the applicable warranty period.
  • Products must be returned without disassembly or alteration unless prior approval is obtained from OBR/Red Rhino. Disassembly without approval voids the warranty.

Warranty Coverage

  • OBR/Red Rhino warrants products and parts found, upon inspection, to be defective in material or workmanship.
  • Remedies are limited to repair or replacement of defective products or parts, at OBR/Red Rhino's discretion.
  • Repairs are performed solely by OBR/Red Rhino; costs from third-party repairs are not covered.
  • OBR/Red Rhino disclaims all implied warranties (e.g., merchantability, fitness for a particular purpose) and liability for incidental, consequential, or other damages beyond repair or replacement.

Exclusions from Warranty

This warranty does not cover:

  • Misuse, neglect, accidents, improper maintenance, operation, or installation, or damage from rust/corrosion.
  • Altered or modified products.
  • Normal wear and tear, or issues caused by incompatible parts or accessories (per OBR/Red Rhino's judgment).
  • Rounded clutch dogs.
  • Rental, commercial, or high-performance use (e.g., racing).
  • Damage from water entering engine cylinders via exhaust, carburetion, or fuel-injection systems.
  • Costs for haul-out, launching, towing, storage, loss of time/income, or other incidental/consequential damages.
  • Electrical components (e.g., stators, powerpacks, switchboxes, solenoids, trim relays, alternators, voltage regulators, starters, trim motors).

Arbitration

  • Disputes arising from this agreement or the product's sale, condition, repair, or service will be resolved exclusively by arbitration in Mobile County, Alabama, under the Commercial Arbitration Rules of the American Arbitration Association.
  • A single arbitrator will be appointed by the Presiding Judge of the Circuit Court of Mobile County, Alabama, unless otherwise agreed.
  • The arbitration award is final and binding, enforceable in any court with jurisdiction. Non-payment claims are exempt and may be pursued in Mobile, Alabama courts.

Entire Agreement

This document is the complete agreement between OBR/Red Rhino and the purchaser. Changes must be in writing and signed by the President of OBR/Red Rhino and the purchaser.

Indemnity

The dealer/purchaser agrees to indemnify and defend OBR/Red Rhino against claims seeking remedies beyond this warranty's scope.

Return Authorization Process

Initiating a Warranty Claim

  • Contact Hawkeye Marine, LLC at 615-691-1433 or orders@hawkeyemarine.net to report the issue.
  • We'll start the warranty process and issue you a Return Authorization (RA) number.

Preparing the Warranty Package

  • Write the RA number on the outside of the package, at least 3" tall and circled for visibility.
  • Include inside the package: a copy of the original purchase invoice, a written explanation of the problem, and the RA number written on both the explanation and invoice.
  • Insure the package for the product's value and pack it securely. The sender is responsible for loss or damage in transit.
  • Do not use a Core Return Label for warranty returns — it's for cores only and provides insufficient insurance.

Evaluation and Resolution

  • Warranty returns receive top priority. An OBR warranty team member will contact you promptly with an evaluation.
  • If defective due to OBR parts or workmanship: the product will be repaired or replaced at no charge, returned freight prepaid within the contiguous U.S. Shipping costs up to the original purchase shipping fee will be refunded.
  • If not covered (e.g., due to misuse or excluded conditions): repair and return at a reduced rate may be offered, discussed case-by-case with the original purchaser.

Additional Notes

  • Returns without an RA number will be sent back freight collect, no exceptions.
  • Orders refused at delivery incur shipping charges.
  • Core Return Deadline: if a core deposit was paid, the core must be returned within 30 days of delivery to qualify for a refund. Late returns may be rejected or receive a reduced refund at OBR's discretion. See our Core Return page for details.
